No country is an island and even though some details may vary for historical reasons and other "local" factors there is a surprising commonality in the general principles of corporate and commercial law.And there is a growing tendency for local legalisation to contain provisions mandating the courts to give recognition to the legislation and case law of "foreign" jurisdictions in adjudicating the matters being presented before those courts.Appreciating how the Courts in different jurisdictions are developing and applying the law has become a vital element of any legal adviser (and even others whose primary function is understanding the legal implications of their business function) being able to offer his or her client the highest level of expertise.Graeme and Veldra Fraser are corporate and commercial law consultants in South Africa with a passion for reading, writing and teaching. For the past 14 years they have (in addition to writing a number of other legal titles) compiled an annual Company Law Casebook which they have successfully marketed to their South African client base.
