KEY FACT:
Discovered Orlando Health does not take new Ambetter patients since May 2023 but honors all old Ambetter patients.
THEORY:
Orlando Health is colluding with Ambetter to lock old patients into their Stand Silver VALUE plan (2023) which was formerly a Zero-Out-Of-Pocket Premium plan by using an Upcharge Scheme for 2024.
My theory assumes that any plan change by the patient from the formerly zero out of pocket cost Standard Silver VALUE plan (2023) to the CURRENT out of pocket cost Standard Silver plan (2024) would constitute "New Patient Status" and thus void their current relationship with Orlando Health.
Thus, though a new alternative zero out of pocket plan exists for 2023 (Standard Silver Plan) it is very doubtful that any old Ambetter member would switch to it because if they did, they would have to start all over with a new doctor not in the Orlando Health network.
This theory remains to be verified. However, I will be calling Orlando Health and attempting to verify how they categorize patients that switch their insurance plans to determine if they remain concurrent or if they are classified as "new".
Further Points: I talked to three scheduling reps prior to making this theory and they all verified that Orlando Heath stopped taking new patients with Ambetter insurance. Two verified that as scheduling reps that they have Portal access to Ambetter and they have tried since May 2023 to get Ambetter to update their website.
Theory Speculation: How can TWO major companies be incapable of clearing this problem up? How can 'some' of the Ambetter customer service reps and all the Orlando Health scheduling reps be telling BOTH Orlando Health and Ambetter that since May of 2023 Orlando Health is not accepting new patients and that Ambetter is NOT updating its website? I even lodged a formal complaint with an Ambetter customer service rep. Yet the site to this date (Jan. 29, 2024) still claims to be in business with Orlando Health with zero distinction in PCP selection for old versus new Ambetter insurance customers and not a single Ambettter customer service rep is aware (except the ones I've made aware) let alone knows how to deal with this problem. This level of incompetence cannot be 'natural'.

I just got off the phone with the scheduling department at Orlando Health where I presented myself as a current (not new) patient with Orlando Health. I talked with a rep (Kristiana) that spoke perfect English and who I consider to be quite competent. She emphatically confirmed, that if I switched plans from Ambetter Standard Silver VALUE (which I am in and was formerly a zero out of cost plan for 2023) to ANY other plan, be it within Ambetter or any other Insurance provider, I would be kicked out of the Orlando Health Network. She confirmed that I am locked in to my 2023 Standard Silver VALUE plan with ZERO recourse.
Not only did she confirm this, but she said that I'm not the only person calling Orlando Health with this problem and that many other insurance providers are doing the same thing to their customers. She named Care Plus and Blue Cross specifically. Whatever these companies are doing, they are doing it together. They are all locking in their current ACA customers and UPCHARGING them for absolutely no reason or gain in benefit for their already impoverished customer base. If this true, my faith in this system is even less than what it was before. I didn't think it could get worse. But then, it did.
I don't know what reasoning or twist of law these companies are using, but they are causing a massive disruption and just as I predicted, many calls have come in to Orlando Health with the same problem that I have brought to you. It's live, it's active. It's happening now.

As far as I can tell, the two following plans that I will be talking about, are only cosmetically different and have no foundational difference other than the one that cost me money, is more restrictive. How does that make sense? To me, this seems contrived.

PLANS:
A person qualifies for a DOLLAR AMOUNT under the ACA.
They do not qualify for an insurance plan. Though the following plans have the appearance of different attributes, it is NOT the plan that matters, it is the dollar amount covering the plan that matters. Rather, both plans are 'engineered' to align with the dollar amount approved in the EXACT SAME way. One just charges the customer for no extra benefit and the other one doesn't.
The company sets you up to believe you have a ZERO PRICE PREMIUM PLAN then switches it to a PRICED PREMIUM PLAN. All the while telling you before hand that they will auto-renew you, while having you believe you are ALREADY enrolled for 2024 because you joined during the 2024 Enrollment Drive.....or so you were led to believe. The truth is, they somehow got me enrolled BEFORE the official 2024 Enrollment Drive, duped me, then planted a trail of mixed-message communications for plausible deniability. Then I called them (Dec. 26, 2023), and they tell me to pay and they lie about "law changes", then tell me to cancel. I refused to cancel and I said fix it. To this day I still have no idea for sure what plan I'm in.

A DISTINCTION WITHOUT A DIFFERENCE:
The Customer is paying $5.90/month for the exact same plan but with RESTRICTIONS. All Covered Services and Out-Of-Pocket Expenses are the same.
My argument is that the Standard Silver VALUE (plan) should not even exist. But customers are being pushed into it without knowing it. Just like I was.

SPECIAL NOTE:
Other than the Oct. 26, 2023 emails, I never saw a single email UNTIL Dec. 26, 2023 when I received my bill for December dated Dec. 6, 2023 on Dec. 26, 2023. It was then I began my own investigation. It was then I found emails telling me about renewing my enrollment which I didn't even know I had to do because I already thought I was enrolled for the 2024 Enrollment Drive. Even so, my account Enrollment Page (see Link #7) clearly states in the Red Box that if my enrollment information hasn't changed then I need DO NOTHING. Thus any responsibility on my part to watchdog AMBETTER goes out the window. There was ZERO need or responsibility on my part to RENEW or SHOP for a new plan when
1. I already thought I was enrolled in 2024 and
2. AMBETTER literally tells me I don't need to do anything if my information hasn't changed. MEANING......they already know there is NO CHANGE IN THE 2024 ACA LAW regarding QUALIFICATIONS. Thus when they told me over the phone - on Dec. 26, 2023 when I called customer service - that the reason my Plan went from a ZERO Out-of-Pocket Premium to a $5.90 Out-of-Pocket Premium was do to a change in the ACA Law, they were lying. They can't have it BOTH WAYS. They can't say "If you have no household changes" do nothing (see Link #7) and at the same time say "The law has changed making your household qualifications part of a reformulation of ACA benefits for 2024 thus YOU HAVE TO RE-APPLY". The point is moot in either case because as I stated, qualifying for the ACA benefit and making a plan selection are two very separate tasks. The first does not effect the second. But my point is, they are purposely being deceptive.

I already have my enrollment card which I was led to believe WAS for the 2024 Enrollment Drive. But no....it was a sneaky enrollment in which I was led to believe my plan was a ZERO PREMIUM PLAN. This set my psychology up to trust that I was all set to go. Wrong. Also note, it says I'm in the Standard Silver VALUE (plan), which according to my Nov. 7, 2023 bills says I have ZERO Premium to pay.

The first time it is clarified that a warning is given about a higher premium but at the same time it is saying I will be enrolled in my current plan which I believe to have a ZERO premium.

This bill is dated (Dec. 6) but I don't receive it until Dec. 26, 2023 because I made a note on the envelope. It arrives late but regardless It WAS ALREADY IN THE MAIL BEFORE the first email (Dec. 4) stating anything about an increase in PLAN PREMIUMS. Please tell me this this is not a contrived 'coincidence'. I'm warned of a price increase a day and a half before I get the price increase that was already in the mail. Are they even trying? Remember, I still have until DECEMBER 15th to enroll for 2024 but they have already AUTO-RENEWED ME and bumped me up to an out-of-pocket plan BEFORE even noticing me that this was about to happen. THIS IS A BAIT AND SWITCH.....PERIOD.

As can be seen from this letter (Dec. 15) dated AFTER the date for the December bill (Dec. 6), AMBETTER essentially fabricates a myth about higher premium rates and encourages me to re-enroll into the Standard Silver VALUE (plan) which they have already auto-renewed me and billed me for as stated prior (Dec. 6). It is as if they purposely locked me into a bait and switch pushing me past the deadline
(Dec. 15) thus making it impossible to use their online site to correct their malfeasance. A malfeasance I didn't even know was occurring because why would I be re-enrolling for the 2024 Enrollment Drive when that is exactly what I thought I was already enrolled in. This isn't a "comedy of errors". This is planned. And I know it was planned because of their defiance over the phone. Making me wait. Making me speak to somebody higher, then telling me "oh the law changed". Yeah it changed. It issued MORE money for the ACA do to INFLATION. But from what I can tell, that is all that changed. All the qualification questions and answers seemed upon examination to be the exact same as what transpired over the phone when I was enrolled by TrueCoverage on behalf of AMBETTER on Oct. 26, 2023 for what I led to believe WAS for the 2024 Enrollment Drive.
Further, looking at the BACK SIDE of the letter (an maybe I'm wrong here) but it seems to clearly state that my premium "change" (rather stayed the same) to ZERO. However the Maximum Out-Of-Pocket apparently DID CHANGE (Implying this is an actual list of active and current changes) from $1,700 on my Membership Card to $1,800
(See #18 Nov. 1).
So what am I supposed to believe? One thing changes but one thing doesn't but I get billed anyway?

My Ambetter Membership was suspended. I'm assuming because I did not pay the December 2023 bill, even though I have all the way until Jan. 16, 2024 to modify my plan selection according to all the Marketplace information I got. However it also says I've been auto-renewed (Dec. 19, 2023 See Below) because I didn't select a plan by Dec. 15, 2023 even though I was auto-renewed and billed BEFORE that date without notice as far as I can tell. (See Links #27 and #28)
Special Update (Jan 29, 2024): Agent Niya at Market Place told me on Jan. 15, 2024 I was Auto-Renewed on Dec. 19, 2023.
47. On Jan. 12, 2024 I called Ambetter to get my membership suspension corrected. To do so I was force to pay the Dec. 2023 bill of $5.90 for the Standard Silver VALUE plan for January 2024 which to this date I still have not gotten an adequate explanation as to why this plan went from a ZERO Out of Pocket Premium plan to an Out of Pocket Premium plan.
Regardless, I pay it because I actually do need to see a doctor and this is the only way I am going to get there. I also request the customer service rep (Christian Glenn) to enroll me with a PCP. He looks them over and finds which on accepts people over 18 years of age that are close and enrolls me with Orlando Health's Andrea C. Bascan after which time ran out and their offices closed for further communication.
Further, to make sure my membership was not suspended again I enrolled in AUTO-bill Pay which I believe was set to pay February's bill on January 15th.
48. On Jan. 29, 2024 at 10:33am I go onto Ambetter's website to again find my membership suspended for lack of payment February 2024 bill, which should be impossible since I enrolled in Auto-bill pay on Jan. 12, 2024 when I corrected my previous suspended membership by paying the Dec. 2023 bill for Jan. 2024. I confirmed with my credit card company that the bill was not paid. However as can be seen Ambetter has my credit card on file and could have billed for February at any time since Jan. 12, 2024. If I had to come to the website as preparation for my phone call with Mr. Kellogg I would have never known my membership was again suspended and might have very likely been force to pay my entire doctor bill from my visit scheduled Feb. 9, 2024.
Also, the Ambetter website still has me enrolled with Orlando Health's Andrea C. Bascan which does not accept new Ambetter patients as of May 2023.

AMBETTER has 3.6 million members of which 84% are in Silver Plans. How many of those people just got their FREE Standard Silver VALUE plan (2023) switched to an Out-of-Pocket Premium Plan (2024) AFTER they have already selected a PCP in an HMO Network and actually gone for a medical visit? How many are now more or less TRAPPED by this deceptive maneuver by AMBETTER?

This articles has some information (Green Highlights) about how if the Medical Loss Ratio is below 80% then the balance has to be refunded to the patients. Does this mean AMBETTER owes me
$683.62 for November 2023 and $702.90 for December 2023? And if so, what about January through December 2024 in which AMBETTER will be receiving ACA Premium Payments while denying me coverage because of their suspension of my account? Or will they stop receiving ACA Premium Payments and have to refund the government? Or am I simply not understanding the meaning of the article?

The vast majority of the listed PCPs are with Orlando Health which as I learned in a conversation with their scheduling department on

SUMMARY:
A. I enrolled with the ACA program Oct. 26, 2023 by calling a phone number from an ad on Youtube. I enrolled under the express understanding that I was enrolling for the year 2024. I never expected to be enrolled anytime in 2023 or expect any benefits or expect to receive any bills. I fully expected that my membership and my benefits would begin in 2024. Further I had no understanding or knowledge of how the market place worked. All I knew is the person who enrolled me got me both qualified and approved with the market place AND slotted me into an Insurance Plan. I didn't understand the difference at the time. I though they were the same thing. We talked quite a bit about the insurance plan because I quadruple checked with him that I would be paying ZERO out of pocket for premium payments and he confirmed this to be the case. My paying zero out of pocket was the single determining factor for my answering the qualifying questions and enrolling. I believe at the time he also confirmed that his company (I didn't know the name at the time) would be auto-renewing my enrollment with the market place/insurance plan (remember, I believe these are one and the same thing). I fairly certain I agree, because I was in fact later both qualified with the market place and my insurance plan were both renewed on or around
Dec. 15, 2023 as best as I can determine from the evidence I've gathered in my emails which I never even saw until Dec. 26, 2023 which I will now explain as to why I never saw these emails. The reason is, I was never told to look for any emails. And why would I? As far as I'm concerned the entire process is over and down with. I was never asked to confirm my enrollment through email or check any emails for any information. It was only later on Dec. 26, 2023 did I start my own investigation as to why I was getting billed in December that I saw any emails. The four emails I got on Oct. 26, 2023 were essentially irrelevant anyway and none asked for a confirmation. All emails and links to them are listed below for reference. At this point the process on my end is over. At this point I believe I will be waiting for material telling me what to do for 2024.

B. I can't say for sure the exact dates that the bill from Ambetter arrived in the mail at my house (this is also the first time I learn what company I guess is running my insurance plan) or when my Ambetter insurance card arrived. But they both came in November. The bill is dated Nov. 7, 2023 and it confirmed that I did indeed owe ZERO out of pocket premium payments. It also showed that the government was paying $683.62. This fact is important because the next bill in December 2023 states that the government is paying $702. That change signaled to be in my brain, that something significantly changed without my knowledge or my permission. Now I had no clue what changed or why. Remember, I barely understand what is going on. I have no experience with this at all. What I know, is that medical insurance is always a nightmare to deal with and when I got the bill for December I regretted getting involved. Anyway, back to the Nov. 7, 2023 bill. When I looked at that zero out of pocket premium payment I was actually pleasantly surprised. I really didn't hold much hope for a smooth process. But there it was. I felt relieved. Like I was actually going to get some healthcare without the nightmare. As far as I understood the process at this point I had nothing more to do. I did question to myself why was I getting a bill in November for December since I was sure that my coverage didn't start until January 2024. Considering that the widely disseminated enrollment time was from Nov. 1 , 2023 to Dec. 15, 2023. How could I believe the enrollment time was for any period other than for 2024? Why would I question this and more, why would I question any of the process? I still don't know what is going on for sure. I don't even know what my next step is. I still have to figure that out. I vaguely remember talking to the man that enrolled me over the phone or somebody else that I had to log onto a website. But I cannot remember if they told me it was Ambetter at the time. But it really doesn't matter. I have the bill now and I know I have to at some point find a doctor and I'm smart enough to know I have to go to Ambetter's site to do this. But remember I believe I can't do this until January 2024 because I believe that is the time I'm enrolled for. So this November bill is some kind of anomaly that I can't explain. But it says ZERO out of pocket payment and that is all I care about.

C. Sometime later in November I received in the mail my Ambetter membership card. I only glanced at it and left it in the envelope and added it to the Ambetter bill on my dresser. I never looked at it again until I prepared the links on this website for Mr. Kellogg on Jan. 8, 2024. And that was when I confirmed what insurance plan I was actually in because it doesn't say on the bill. However the card did. That was when I figured out I was in the Standard Silver VALUE plan. That was the plan I enrolled in on Oct. 26, 2023. That was the plan that had a ZERO out of pocket premium payment. That was the plan I was auto-renewed in without having to answer anymore qualifying questions with the market place or have to manually select myself. My enrollment in the market place, my enrollment in the insurance plan and the auto-renewal of both were performed by Ambetter and or its partnered marketing company (TrueCoverage). My hands were completely clean of all of this. As as best as I can remember.

D. I can't say for sure what the exact date was when I received my December bill but it was probably on or very near Dec. 26, 2023 when I opened another piece of mail from Ambetter telling me to renew my insurance plan by Dec. 15, 2023. And it kind of threatened me. It warned me about estimated new out of pocket charges for premium payments in 2024 and suggests that I re-enroll IN THE VERY SAME INSURANCE PLAN that I'm already in, that I've already auto-renewed in and that it's the very same plan that Ambetter is warning me about concerning estimated increases in my out of pocket premium payments! How is that for confusing the customer? Warning, you are going to pay more, now re-enroll in the plan that is going to make you pay more. It's crazy. I ignored this letter because it was meaningless to me. But I did not ignore the December bill dated Dec. 6, 2023 that I opened along with it. When I saw the premium charge of $5.90, I was to say the least, furious. This is when I noticed the government was now paying $702. At this point I knew there was a bait and switch going on. I immediately called Ambetter's customer service. They say pay the bill. I refuse. I demand to speak to a supervisor. They tell me I will be speaking with somebody from the market place, which I still don't understand the difference at this point and why would somebody from the market place be concerned with my Ambetter bill? Anyway, this woman tells me to pay. I refuse. She tells me to cancel my membership. I refuse. At this point I'm boiling mad and demand that my plan go back to zero premiums. I don't demand a change in my insurance plan because why would I? I still believe I'm in the plan I enrolled in. She finally relents and says "I'll switch you back". Now I'm super pissed off. Now I know I got bait and switched. I demand of her to tell me which plan I'm in and which plan Ambetter switched me from. She tells me the two plans but I'm so angry my notes are scatter brained. I later made the correction on my notes but my original notes were not clear. You have to understand, at this point I was illogical. She says Standard Silver and Standard Silver VALUE. At this point in talking to her, I still didn't know for sure what insurance was in. And before talking with, to my best knowledge nobody ever told me and nothing came in the mail told me what plan I was enrolled in. All I know, is that it had a ZERO out of pocket payment which was confirmed by the Nov. 7, 2023 bill. That is all I new because I never chose the plan, it was chosen for me on the stipulation that I was guaranteed a ZERO out of pocket premium payment. That is what I contracted for. I did not contract for a plan, I contracted for a price. And that was confirmed by the November bill. The December bill dated Dec. 6, 2023 (though I did not see it until Dec. 26, 2023) was an absolute surprise to me. Anyway I demanded a new December bill to confirm I owed no December payment. I assumed the problem was resolved. It wasn't. The new bill never came and on Jan. 10, 2024 my Ambetter membership was suspended for non-payment.

E. I intuitively knew that some kind of enrollment scam is taking place. All the facts started adding up in my head. At some point I check my email for the first time to see if I missed something and I review all the emails. I go through anything I got from Ambetter. I create an Ambetter account and go on the site. And I start to put it all together. It's a learning curve for me. But I slowly figure it out. I make contact with Mr. Kellogg's office but they are out until
Jan. 3. 2023 if I remember correctly. But Mr. Kellogg makes contact with me on Jan 8, 2024 and sets up a call for Jan. 9, 2023 giving me time to put this list of links together and make some sense of the time line. It was actually by doing this timeline on Jan. 8, 2024 that I actually for the first time took a close look at my membership card which did confirm that I was ALWAYS in the Standard Silver VALUE plan. This was the plan that is supposed to have zero out of pocket
premium payments. I was never switched out of it. Ambetter CHANGED the terms of the plan without noticing anyone. I never got any piece of mail or any email to my best knowledge that explicitly stated that the Standard Silver VALUE plan was changing its terms. What I did get was a packet stating that I have to take care of re-enrolling and selecting a plan for 2024 or my premiums may go up. I received this packet on Dec. 26, 2023. However it's dated Dec. 15, 2023 and it tells me I have to fix this mess by Dec. 15, 2023 all while already having auto-renewed me in my current plan for January 2024 and billed me on Dec. 6, 2023. Is this how a responsible company behaves? I should have never been enrolled in 2023 or billed in 2023. Nothing should have ever occurred until after Dec. 15, 2023. My first bill should have arrived in January 2024 or late December 2023 and it should have been EXACTLY for what I contracted for. ZERO out of pocket premium payments. Ambetter set up some kind of pre-November 1st enrollment scam to set people up just like me so they could change the terms on them later. To me the evidence is absolute clear. They took the government for an extra $1,385 dollars giving me no service and then they scammed me and gave me resistance when I contested my bill. All this added up in my head as one giant scam to take advantage of people. Later, upon further consideration, I realized that there could be millions of people already enrolled in the Standard Silver VALUE plan and have already seen their doctors and established relationships or could be partaking in ongoing medical treatment. Does Ambetter think that all these people are going to just change Insurance Networks and Doctors just to save $5.90 a month? Of course not. Ambetter is betting that they won't change. They are counting on it. All this nonsense about re-enrolling, getting qualified with the market place and choosing your plan is just cover for the scam. When look at the Standard Silver vs the Standard Silver VALUE plan, they are exactly the same. The only two differences are their networks and the Standard Silver plan which now is the zero out of pocket premium plan doesn't require any referrals or prior authorizations for anything. The Standard Silver VALUE plan which went from zero out of pocket premium payments to $5.90 does. So not only are they charging all those people who once thought they had a free plan but they are possibly adding restrictions. I can't prove they are adding restrictions because I never saw the plan details before Dec. 26, 2023 and by then I'm sure Ambetter had already updated its plans on its website.

F. After my phone call with Mr. Kellogg on Dec. 9, 2024 I went back to the Ambetter website to find the insurance plan coverage details in order to construct a side by side comparison. Links are below. It was then I saw that my membership was suspended. I contacted Mr. Kellogg for advice. He said pay the bill. So I called customer service and argue with them more about my bill and realized I didn't have the time to figure out all the mess they have done to my membership status, so I just capitulated and paid my bill. I allowed them to put my payments on auto-pay just to see what they do for February. If my only damages is one month of paying $5.90 I would still argue that I have been scammed. I was bait and switched. They never fixed the problem but they did shut down my membership forcing me to pay the bill to ensure that I don't lose my insurance coverage. Remember, all enrollment for coverage is on a schedule. If I miss the deadline, I could be kicked off my insurance for the whole year. In my opinion, suspending my account under this time pressure is a form of blackmail or extortion. And I do feel justified in leading the charge for all the participants in a class action against this company. They got me. They twisted my arm and squeezed money out of me under duress after massive acts of deception. I honestly feel that I've only scratched the surface of the problem.
If you look at (Link #6) and scroll down to the green section, you will see that the government has already taken note of these confusing plans game that insurance companies are doing. The government has already stated that finance harm as occurred. The precedent has been set. What I have exposes is just a derivative of what companies like Ambetter have already been doing. They are raking it in from government subsidies and they are deceiving their customers. This is probably why the government is making these big companies reimburse people's premium payments
(see Link #48) and scroll to the green section. Does this mean Ambetter is withholding a payment to me or the government of $1,385 dollars because I got zero healthcare in November and December 2023 and may not get any for January 2024 do to all the problems I'm having. How much money is going to be paid to this company before I get to even see a doctor for the first time? And that is where I stand.
